Versuchter Mord mit Verdeckungsabsicht, Geiselnahme, gefährliche Körperverletzung, sexueller Missbrauch eines Kindes – schon bevor der Prozess gegen einen 47-jährigen Marienheider vor dem Kölner Landgericht begann, war die Liste der Vorwürfe erheblich.
Doch als Staatsanwalt Stephan Klatt die Anklageschrift verlas, endete sie nicht mit dem Sturz eines heute 19-Jährigen in der Nacht zum 10. Dezember von der Staumauer der Brucher Talsperre in 20 Meter Tiefe. Die Liste ging weiter: Nicht nur den 19-Jährigen, sondern eine ganze Reihe weiterer Jugendlicher im Alter von 13 bis 18 Jahren aus seiner Nachbarschaft soll der heute 47-Jährige in den vergangenen neun Jahren sexuell missbraucht und laut Anklage zum Teil sogar vergewaltigt haben. Mit mehreren Jungs gleichzeitig soll der Mann auf einem Campingplatz übernachtet und immer wieder mit ihnen Alkohol getrunken haben. „Es war eine Mischung aus Vorteilsgewährungen und gewalttätiger Bedrohung, mit denen er den Jugendlichen vermittelt hat, das sei eine unausweichliche Gegenleistung“, so der Staatsanwalt. Im Falle einer Verurteilung droht dem 47-Jährigen eine Sicherungsverwahrung. Die Staatsanwaltschaft sieht in der Anklage die Voraussetzungen dafür erfüllt.

Im Sommer 2014, so die Anklage, hatte der damals 18-Jährige Strafanzeige gegen den Marienheider erstattet. Als im November die Wohnung des verheirateten Mannes durchsucht wurde, soll er zum ersten Mal von dem Verfahren gegen ihn erfahren haben. Danach, so die Staatsanwaltschaft, kam es zu den Ereignissen in der Nacht zum 10. Dezember: Zunächst soll der Mann, unter anderem mit Messer und Axt bewaffnet, in das Zimmer des Jungen eingedrungen sein. Er habe ihn gezwungen, zwei Abschiedsbriefe zu schreiben, eine SMS an die Ehefrau des 47-Jährigen zu verfassen und eine Nachricht auf ihrer Mailbox zu hinterlassen. Darin kündigte der 18-Jährige jeweils seinen Selbstmord an und nahm die Vorwürfe gegen den Mann zurück. Danach sei der 47-Jährige mit ihm zur Staumauer gefahren und habe ihn dazu gebracht, sich an den Händen des Mannes rücklings über die Mauer zu beugen.
Warum ließ sich der 18-Jährige darauf überhaupt ein? Der Antrieb soll, wie diese Zeitung erfuhr, ein vom Angeklagten verlangter „Vertrauensbeweis“ gewesen sein: Wenn der junge Mann sich darauf einlasse, könne das Ganze auch noch gut ausgehen.
Dazu kam es nicht. „Der Angeklagte hat, wie von ihm zuvor geplant, losgelassen“, so Staatsanwalt Klatt. Trotz schwerer Kopfverletzungen überlebte der Junge den Sturz.
Was der Angeklagte vor Gericht zu den Vorwürfen gesagt hat, blieb zunächst unklar. Bevor er sich äußern konnte, erklärte die Vorsitzende Richterin Sabine Kretzschmar, dass die Öffentlichkeit während seiner Aussage ausgeschlossen wird – vor allem zum Schutz seiner mutmaßlichen Opfer.
Vor Beginn des Prozesstages hatte sein Verteidiger Stephan Kuhl erklärt, dass sein Mandant mit dem, was ihm die Anklage vorwirft, „nicht komplett einverstanden“ sei. Der Prozess wird am nächsten Montag mit der Vernehmung des heute 19-Jährigen, der von der Staumauer stürzte, fortgesetzt – wohl auch unter Ausschluss der Öffentlichkeit.

In the case of a conviction, the 47-year-old is threatened with a security deposit. The prosecution sees the accusation as fulfilling the prerequisites.

In the summer of 2014, according to the accusation, the then 18-year-old criminal complained against the Marienheider. When the married man's apartment was searched in November, he was said to have learned about the trial for the first time. According to the prosecutor's office, the events took place on the night of December 10th: the man, armed with a knife and ax, was first to enter the boy's room. He had forced him to write two farewell letters, write an SMS to the 47-year-old's wife, and leave a message on her mailbox. In it, the 18-year-old announced his suicide and took the allegations against the man back. After that, the 47-year-old had gone with him to the Staumauer and had made him bend over the wall behind the man's hands.
Why did the 18-year-old let himself into it at all? According to this newspaper, the drive was supposed to have been a "test of confidence" demanded by the accused: if the young man were to accept it, the whole thing could still go well.
This did not happen. "The accused has let loose, as planned by him before," said prosecutor Klatt. Despite severe head injuries the boy survived the fall.
What the defendant said before the court to the allegations remained unclear at first. Before he could express himself, the President-in-Office, Sabine Kretzschmar, stated that the public was excluded during his testimony - especially to protect his alleged victims.
Before the start of the process, his defense counsel, Stephan Kuhl, had declared that his client was "not completely satisfied" with what the accusation accused him of. The trial will be continued next Monday with the interrogation of today's 19-year-old, who was overthrown by the Staumauer - probably also without the public.
