Silva died in San Jose in 1989 after being shot in the stomach and leg. Silva was responding to a call of a officer down at a Winchell's Donut shop in downtown San Jose. He was shot by the perpetrator as Silva was getting out of his patrol car.
The flagpole is located outside of the mall by the Starbucks and Johnny Rockets.
