After much public outcry over the arrests, Mayor Tom Richards authorized a permit for overnight use until January 11, 2012, and a tent city sprang up south of the Civil War Monument. He refused to have the trespass charges dropped, however.

On January 12, 2012, (ironically) the charges were dismissed for the first 28 protestors charged with trespass, as the judge ruled that not every element of definition of trespass had been met. A second group of 16 charged protestors have not yet had their day in court, but the outcome is expected to be the same.

As for the tent city, the permit has expired, and a new permit has not been issued. Gary Walker, spokesman for the city stated, on the record, that there would be no fireworks... no mass arrests. But that the occupiers would eventually have to leave, preferably in the spring, so that grass could be replanted and "repairs made".
