In August 2002, the Seneca Nation of Indians signed an agreement with the State of New York to open and operate three casinos in Western New York. The third and final casino was to be located on sovereign land in downtown Buffalo, land that the Senecas once laid claim to. On October 3, 2005 the Senecas acquired 9 acres of land just on the outskirts of downtown Buffalo to build the Seneca Buffalo Creek Casino.
In order to fulfill the compact with the state, a casino needed to open by 2008 otherwise they would lose their exclusivity. A temporary casino was opened July 3, 2007 in the northwest corner of the site. A $333 million permanent casino and hotel are currently under construction on the remainder of the site.
The land is dedicated as sovereign territory and all laws applying to Native American lands apply, despite it only being 9 acres in size.
