Otoe county was formed and Nebraska City made the county seat in 1855 while Nebraska was still a territory. The brick Italianate courthouse, the oldest public building in the state, was completed in 1865, two years before Nebraska became a state. A wing was added to the west side in 1882 and an identical wing on the east side was build it 1936. Signs inside on the first floor identify walls which were part of the original structure and those added later.
The building, which is on the National Historical Register, occupies a block in downtown Nebraska city.
