Realizing the need for such a facility, the Cherokee National Council authorized the construction of a prison facility in 1874, using funds realized from the sale of the Cherokee Outlet. The cost of construction was $6000 and produced one of the major tribal buildings in Tahlequah during this period. Originally a three-story building (two floors above ground and a half-basement), the prison housed the most dangerous and hardened criminals. It was said that no convicted criminal left the facility other than to hang on the scaffold behind the prison. The upper floor were eventually removed. Today, the building is part of the Cherokee National Prison Museum complex.
